NOB-Mumbai news: If either spouse threatens to commit suicide or makes such an attempt it falls under torture or a divorce can be granted under Section 13(1) (ia) of the Hindu Marriage Act, 1955, the Bombay High Court has ruled. A man approached the court saying that his wife was threatening to commit suicide and was threatening to send him and his family to jail. He requested the family court to grant him a divorce as he could not live with her anymore. He got relief there and challenged the verdict and approached the High Court. She is threatening to kill herself and send her husband’s family to jail. If either spouse commits such acts, it is to torture the other. Therefore, a divorce can be granted, said Justice RM Joshi of the Aurangabad bench of the Bombay High Court. The man from Maharashtra got married in 2009. The couple has a child. However, he stated in his divorce petition that their marriage collapsed due to the arrival of his wife’s relatives. He said that his pregnant wife left him and has not returned since then. However, after some time, she started threatening him with false cases. In this process, she threatened to commit suicide and blame the crime on her husband’s family. The husband, who submitted the relevant evidence and documents to the court, was finally able to get a divorce from the family court in February month 2025. The wife challenged the verdict, but the Bombay High Court recently upheld the verdict.
